| 内容記述 | Given the high frequency of natural disasters in China, it is crucial to know what disaster-related laws have been in place. An overview of studies on disaster response systems and actors reveals that only a few studies on individual and disaster-affected area have been done. Therefore, this paper aims to clarify the position of individual and shaku in China's disaster response. In Chapter 1, the author describes the scope and basic situation of natural disasters and summarizes the establishment and development of disaster response systems and previous studies. In Chapter 2, the author introduces the basic information on the “Four Laws on Disasters," extracts provisions related to individual, and confirms the guarantees by the government for individual rights and the roles expected of individual. In Chapter 3, the author extracts provisions related to shaku and compares them by disaster stage. In Chapter 4, the author examines the types of assistance that the government provides to disaster victims and the items and criteria of the natural disaster reduction funds. Through these studies, the author clarifies the position of individual and shaku in China's disaster response, confirms the extent of coverage and the role that individual should play, and discusses whether disaster victims can rebuild their lives by relying on “public assistance" or not. In conclusion, both individual and shaku are in a “cooperative" and “passive" position in disaster laws. Based on the above, the author concludes that it is not optimistic that individual will be able to rebuild their lives solely by relying on “public assistance." How individual can rehabilitate their lives is an issue that should consider in the future. | |||||||||||
