| 内容記述 | This paper considers the discussion about the "calm divorce period" in China. On May 28, 2020, the 13th National Convention of the people's Congress was adopted by the People's Republic of China on January 1, 2021. In the article 1077 of the "Marriage Family Edition" (NO.1040-1118) "in the civil code" , in the case where one of the divorce parties wants to cancel the divorce within 30 days after the application of the divorce registration application (referred to as divorce), the application for divorce registration may be withdrawn to the marriage registration agency. The setting of a "calm divorce period" was also a matter of great concern to the general public. This issue is divided into pros and cons, and while there are voices in favor that setting a "calm divorce period" can reduce the divorce rate, maintain the marital relationship of the couple, and stabilize the society, the principle of divorce freedom. On the other hand, there are opposition voices that it is disadvantageous for victims of domestic violence. Therefore, this paper summarizes previous studies on why it was necessary to set a "calm divorce period" from the divorce situation in China, and focused on the discussion on the "calm divorce period". At the root of the "calm divorce period" setting is the idea that "divorce = unhappiness". The "calm divorce period" seems to be equal to both sexes, but in reality it works more oppressively on women than on men. There is also concern that women victims of domestic violence may be in greater distress. It has been found that the marriage system in China can be said to be a legally protected means and mediator for individuals to obtain welfare. In the future, it is necessary to develop laws and policies concerning marriage families. Especially, it is necessary to examine DV countermeasures. Research on the "calm divorce period" and the operation in the future are deepened. | |||||||||||
